  • Karstedt S (2012) Democracy, Crime and Justice Sage

    This book is the first comprehensive study on the problems and questions of crime and justice in contemporary democracies. Are democracies more vulnerable to crime and violence? What are the comparative advantages and disadvantages of democracies when doing justice to offenders and victims? Why is justice so much harsher in some of the contemporary democracies? In which ways do democratic values and culture shape crime and justice? The book addresses these questions from a distinctly comparative and international perspective, and shows that cultures and institutions of democracy are vital in preventing crime and promoting justice. It presents original data on crime, justice and democracy, in accessible and easy to understand graphs, which provide “diagnostic tools” as to the role of democratic values and institutions in crime and justice. It presents these data in a number of short chapters both on crime and justice. Crimes included are: interpersonal violence (homicides), violence by the state, corruption, and organized crime. Chapters on justice include imprisonment, citizens, trust and criminal justice, rehabilitation and prisoner’s rights. One chapter will deal with the question of transitions to democracy, and related crime and justice problems.

    This book explores a hitherto neglected aspect of crime in modern society –the crimes committed by otherwise ‘respectable’ citizens in the market arena. It delves into the ‘grey zone’ where illegal practices, unfair, unethical and ‘shady’ practices coalesce. The contemporary ”moral economy” emerges as a ‘moral maze’ for citizens and consumers who are as often victimized as they find themselves confronted with the temptations inherent in market-capitalism. Retailers and tradesmen report that citizens do not hesitate to take illegal and unfair advantages, and consumers feel victimised by the practices of insurance companies and financial services. Consumers and business seem to be engaged in a vicious cycle of unfair behaviour, erosion of good practices and normative standards. Is a ‘predatory society’ emerging from the central sphere of consumption? The book presents an in-depth empirical study on the normative and moral culture of markets and consumption in European countries. It establishes how the ‘economic morality’ of consumers as well as their vulnerability impacts on their trust and citizenship in modern market societies. Chapters explore how the moral climate of the market is constructed, and explain the mechanisms of “market anomie”. The strategic samples allow for innovative comparisons between an advanced market and consumer culture in England & Wales, a market society with strong ‘protective’ state provision in the former West Germany, and a ‘ready-made’ market society in the former East Germany. A final chapter takes a view on the landscape of European moral economies.

    This paper uses (West) Germany as an exemplary case to analyse the formation of collective memories over a period of more than two decades after 1945. It traces the formation of collective memories in the German public through a decade of collective amnesia, followed by a period of regaining collective memories. It argues that the formation of collective memories is embedded in social and normative change, and identifies three causal factors that were responsible for the oscillation between amnesia and memory: the absence of victims in the imminent post-war period, that promoted the myth of innocence (Fulbrook 1999); a series of major trials that started in the 1960s; and young elites who acknowledged moral and legal guilt and supported the trials, reconciliation and compensation. Data from public opinion polls covering the period from 1950-1970 are presented.

    This paper explores the role of the specific structure and culture of inequality of the communist and post-communist countries in the simultaneouswave of elite crime and violent crime in Central and East Europe. Under thelayer of homogeneity, which had been imposed on the region by ethnic cleansingduring and after World War II and by the continuous policies of communistregimes, a substructure and subculture of inequality emerged, which becamedominant during the transition phase. Among the consequences of the ``hour-glass'' society (Rose) and feudalization of society are closely knit networks at the top and the bottom of society, clientelism as a pattern of linking them, and non-egalitarian and collectivist value patterns. This specific cluster combines factors that contribute to both high-level corruption and violence. Pathways of development during the transition periodindicate a bi-partition of the ``geography of crime'' in the region. The relative ``success stories'' of Hungary, Poland and the Czech Republic withboth declining rates of corruption and lethal violent crime (homicide) are in stark contrast to many of the successor states of the Soviet Union. It is argued that strong institutions based on civil rights and the rule of law areimportant factors responsible for this difference.

    http://tcr.sagepub.com/content/6/3/299.abstract During the last decade, a process of ‘emotionalization of law’ has spread around the globe, changing the criminal justice system in many ways. Anger, disgust and shame are perceived as ‘valuable barometers of social morality’ and brought back to criminal procedures. The ‘return of emotions’ to penal law and criminal justice is linked to and illuminates the moral imagination of late modern societies. This article seeks to address two facets of the ‘return of emotions’ to criminal justice. The first part explores the changes in the public sphere and in the pattern of emotional culture in late modern societies that are responsible for the reemotionalization of the penal realm. In the second part, problems that emerge in the criminal justice system are addressed. Bringing emotions back involves profound problems that go beyond the mere instrumental use of emotions in criminal justice, or a restricted perspective of ‘what works’. Three ‘core’ problems—and associated—questions are discussed: first, are emotional reactions towards crimes ‘natural’ or ‘primordial’ such that they should occupy a prominent place in criminal justice that has been unduly ignored? Second, and relatedly, do emotions constitute our moral principles? Finally, should institutions elicit or even require ‘authentic emotions’ from individuals? These questions are addressed within the framework of contemporary emotion theory and the consequences of this perspective for the ‘use’ of emotions in criminal justice are discussed.

    Exchange, transport and import of crime policies takes place on a global scale. New strategies of crime prevention, models of institutions and interventions rapidly spread around the globe. Knowledge is increasingly shared among the `epistemic communities' of criminologists, and criminal justice and policing experts and practitioners. Notwithstanding the global scale of exchange, criminal justice systems and policies are definitely local, and embedded in traditions, culture and the particular institutional regimes of national states. This article explores how crime policies travel within a globalized world of nonetheless local legal and institutional cultures, and how we can conceptualize the routes of travelling they take. The article starts by analysing what exactly travels when crime policies are `en route'. Next, overarching concepts and convergence theories, which have played such a decisive role in analysing the globalization of crime policies are discussed. These are contrasted with loosely coupled concepts like actors, mechanisms and principles, following suggestions by Braithwaite and Drahos (2000). `Modelling' seems to be a mechanism that is most useful in describing present exchange and transport of crime polices.
