Reconciling Corporate and Insolvency Law - the European Insolvency Regulation at the Crossroads

The seminar will discuss the current EU insolvency regime, outlining the gaps in the legislative framework and considering some important issues which have arisen in the Court of Justice of the European Union’s practice. The recently started project on the law applicable to companies will be addressed in the light of the draft text which was already adopted by the European Group on Private International Law (GEDIP). The GEDIP’s proposal is a very recent development which is intended to be in line with the EU Insolvency Regime.

Stefania Bariatti is Professor at the University of Milan; Of Counsel at Chiomenti Studio Legale (Italy), where she provides assistance on Competition, European and International Law; Member of the Milan Bar - admitted to the Italian Supreme Court; Chairperson of the Board of Directors at SIAS S.p.A. and Member of the Board at ASTM S.p.A. and at Banca Monte dei Paschi di Siena (all listed at the Milan Stock Exchange); Member of the Governing Council of UNIDROIT, International Organisation for the Unification of Private Law; Member of GEDIP – European Group on Private International Law; Member of the INSOL Europe Academic Forum, of INSOL Europe and of the International Insolvency Institute.

This seminar is accredited with one CPD hour for barristers at the Bar of England & Wales.
